Text: The Early Childhood Regulatory Authority. Prosecution.

Kidi Kingdom Pty Ltd was fined $12,000 in Brisbane Magistrates Court after a 10-year-old child in the care of Kidi Kingdom, Pimpama, left the premises unnoticed and was unsupervised and unaccompanied by staff from the service for approximately 1 hour and 15 minutes.

In this case, it could not be confirmed how the child left the service, but they were located by a member of the public after presenting themselves at a private residence.

No conviction was recorded.

The Department of Education, as the Early Childhood Regulatory Authority, prosecuted the service's approved provider after its investigation into the 7 November 2023 incident.

Kidi Kingdom Pty Ltd pleaded guilty to 2 charges:

  1. Section 165(1) of the National Law—Offence to inadequately supervise children
  2. Regulation 99(1) of the National Regulations—Children leaving the education and care service premises.

The fine of $12,000 reflects the seriousness of these offences.

On 8 May 2026, in deciding the defendant's guilt and sentence, Magistrate Grace Kahlert noted the seriousness of the offence, which exposed a 10-year-old child to risk after they left the service without adequate supervision. Magistrate Kahlert emphasised that all children are inherently vulnerable and that providers must take appropriate steps to ensure children's safety.

Magistrate Kahlert also took into account the steps taken by the defendant following the incident, including actions to address the issues identified, and noted that the defendant had no previous convictions. A conviction was not recorded.

This prosecution sends a strong message to approved providers that they have an overriding responsibility to ensure children are adequately supervised at all times and not able to leave the education and care service premises.

The department will continue to work with the early childhood sector to promote supervision for children.
